WASHINGTON - (KRT) - On what had been the eve of his widely expected acquittal, the trial of the second person charged by German authorities as an accomplice of the Sept. 11 hijackers was thrown into turmoil Wednesday after prosecutors disclosed the existence of a surprise witness purporting to link Iran to the hijackings.

The mysterious witness, who goes by the name Hamid Reza Zakeri and claims to have been a longtime member of the Iranian intelligence service, is said to have told German investigators that the Sept. 11 plot represented what one termed a "joint venture" between the terrorist group al-Qaida and the Iranian government.

Sources familiar with the witness' story, greeted with pronounced skepticism by some German intelligence officials, say he also implicates the defendant, a 31-year-old former Moroccan student named Abdelghani Mzoudi, as a knowledgeable participant in the hijacking plot.

"If the story was true, the consequences would be remarkable," said one senior intelligence official, who observed that the wittiness' account comes nearly 2 1/2 years after Sept. 11, 2001, and "looks a little bit constructed."

Zakeri is not expected to appear in the high-security Hamburg courtroom Thursday, where officials of the German federal police, the BKA, have been summoned to explain why they believe Zakeri's testimony is credible.

Sabine Westphalen, a spokeswoman for the Higher Regional Court of Hamburg, said the five-judge panel that will decide Mzoudi's fate had received a 30-page transcript of the BKA's interview with Zakeri conducted within the past few days.

Westphalen said the federal prosecutor had asked "to interrupt the hearing of evidence for 30 days in order to be able to examine the data of the witness and its reliability." No verdict is now expected before Jan. 29.

The appeal to the court to consider Zakeri's story amounts to a last-minute move by the chief German prosecutor, Kay Nehm, to preserve the fast-fading possibility of a conviction in what is likely to be the last trial in Germany of an alleged accomplice of the Sept. 11 hijackers.

In the first such trial, which concluded last year, another Moroccan student, Mounir al-Motassadeq, was sentenced to a maximum of 15 years in prison for aiding the Sept. 11 hijackers.

Motassadeq admitted knowing some of the hijackers but denied any foreknowledge of the Sept. 11 plot, in which four airplane hijackings resulted in more than 3,000 deaths. Mzoudi has taken essentially the same stance.

According to the German newsmagazine Der Spiegel, Zakeri reportedly said Mzoudi acted as the hijackers' liaison with their al-Qaida support network.

Until now, the case against Mzoudi has been entirely circumstantial, resting on evidence showing that he performed a number of logistical and "housekeeping" services for the principal hijackers, both before and after they left Hamburg to begin flying lessons in the U.S.

The prosecution's theory, not supported by any direct evidence or testimony, is that Mzoudi must have known why Mohamed Atta and Marwan al-Shehhi, believed to have piloted the two hijacked jets that struck the World Trade Center, had quietly departed northern Germany for Florida.

In December, however, the Hamburg court ordered Mzoudi's release from prison after being informed by the BKA that a confessed Sept. 11 co-conspirator, Ramzi Binalshibh, had told U.S. intelligence agents that those who did know of the hijacking plot had "never talked to others about the true operations or the establishment of a terrorist cell" in Hamburg.

Any credible evidence linking Iran to Sept. 11 would have immediate and profound repercussions for U.S. relations with Iran and the Muslim world. Bush administration officials have included Iran with North Korea and the former Iraqi government of Saddam Hussein in what they term the "axis of evil."

The Tribune reported last year that Shadi Abadallah, a 26-year-old Jordanian who said he served as one of Osama bin Laden's bodyguards in Afghanistan, previously told the BKA that one of the world's most-wanted terrorists, Abu Musab al-Zarqawi, described by Secretary of State Colin Powell as an "al-Qaida associate," was closely allied with the Iranian government.

Zarqawi, a one-legged Jordanian national who heads the al-Tawhid terrorist network, which some U.S. officials say is linked to al-Qaida, has been accused by the Bush administration of helping al-Qaida develop plans to attack the West with radioactive and other weapons of mass destruction.

American officials, who say Zarqawi is responsible for the assassination of a U.S. diplomat in Jordan, have placed a $5 million reward on his head.

Kenneth R. Timmerman, a senior writer for Washington-based Insight magazine, said he interviewed Hamid Zakeri during several telephone conversations last summer and that the man "told a very credible story."

Timmerman said he had been able to corroborate a number of the physical details provided by Zakeri concerning such things as the physical layout of the Tehran headquarters of the Iranian Ministry of Information and Security, or MOIS.

According to an article Timmerman published in July, Zakeri said that he worked for the Iranians' "supreme leader," Ayatollah Ali Khameini, and that he was present at two meetings between senior Iranian and al-Qaida officials in the months before Sept. 11.

Timmerman said Zakeri had provided him a document purportedly signed by the Iranian intelligence chief, Hojjatoleslam Ali Akbar Nateq-Nouri, in May of 2001, ordering a strike at this country's "economic structure, their [sic] reputation and their internal peace and security."

Because the Mzoudi case is still before the German court, the CIA declined to comment.

Evidence linking al-Qaeda to Iran delays September 11 trial


A German judge has delayed his verdict in the trial in Hamburg of an accused accomplice of the September 11 hijackers to consider testimony from a new witness: a former Iranian spy who claims to have evidence that links Iran to al-Qaeda.

The witness also suggests that Iranian agents had advance knowledge of the September 11 plot.

The last-minute evidence adds another twist to the trial of Abdelghani Mzoudi, a Moroccan charged with providing logistical help to the Hamburg-based hijackers who carried out the attacks in New York and Washington.

The case against Mzoudi faltered last month when the judge released him on bail, ruling that evidence from an unnamed al-Qaeda figure in US custody cast doubt on whether the accused knew about the hijack plot in advance.

But now the judge has accepted a request to hear two federal investigators testify about the new evidence instead of issuing a verdict on Wednesday as planned. Prosecutors have also asked for a 30-day delay in the trial while they evaluate the credibility of the new witness, a spokeswoman for prosecutors said.

The unidentified witness is described as a former Iranian intelligence agent. Last week he walked into the Berlin offices of the federal investigative police, the BKA, saying he had evidence that the Lebanon-based Hezbollah and its Iranian intelligence allies had ties to some September 11 plotters, sources said.

The Iranian said he had fled Iran in July 2001 and had tried to warn US and French intelligence agents about a big impending attack.

He alleged in a statement to BKA agents that Osama bin Laden's network assigned Mzoudi to handle logistics and communications for the September 11 plot.

The former spy also claimed Mzoudi spent time in Iran, where he was in contact with Saif al-Adel, bin Laden's former chief of security.

Although the witness did not accuse Iran of direct involvement in the September 11 plot, his account - which detailed al-Adel's supposed role overseeing key planning cells in Syria, Germany and Spain - claimed that Iranian spies had advance knowledge of the attacks.

The former spy also provided an email, purportedly sent last month by a top Iranian contact in Iran's Quds intelligence agency, saying that al-Adel ordered al-Qaeda operatives to kill Mzoudi upon learning of his release on bail, sources said.

HAMBURG, Germany (Reuters) - Iran's secret service had contacts with Osama bin Laden (news - web sites)'s al Qaeda network ahead of the September 11 attacks on the United States, a German court heard on Thursday.

Two members of Germany's Federal Criminal Police told a court in Hamburg a former Iranian spy had informed them of the contacts and had also said he tried to warn Washington about the attacks in mid-2001, but that the CIA (news - web sites) had not believed him.

The police officers were speaking at the trial of a Moroccan accused of aiding the September 11 attacks.

The Iranian, identified only by his cover name Hamid Reza Zakeri emerged as a surprise witness, postponing the verdict which had been expected to clear the defendant. His credibility is under scrutiny by the presiding judges.

The witness himself was not in court on Thursday, but presiding judge Klaus Ruehle read out passages from an interview with him and questioned the two German investigators who had listened to his testimony.

The Iranian said he had been in a department of the Iranian intelligence service that was "responsible for carrying out terrorist attacks globally," one of the officers said.

"In 2001, a delegation with Osama bin Laden's son was in Iran," the officer said, quoting the witness.

The witness has been summoned to appear on January 29 at the trial of Moroccan Abdelghani Mzoudi, accused of aiding the September 11 attackers.

Mzoudi, 31, was expected to be cleared of several thousand counts of aiding and abetting murder and membership of a terror organization in a verdict originally due on Thursday, but postponed after the emergence of the Iranian witness.

The sudden new evidence may threaten Mzoudi's chances of acquittal.

MYSTERY WITNESS
The police officers told the court the witness had implicated Mzoudi and had said the Iranian secret service had worked with al Qaeda in 1996 in an attack in Saudi Arabia that killed several U.S. citizens.

He had also said it was an Iranian, Saif al Adel, the military head of al Qaeda, who planned the September 11 attacks.

Prosecutors say Mzoudi, an electrical engineering student based in Hamburg where three of the suicide pilots had lived, handled money for al Qaeda, helped cover for group members' absence and trained at an al Qaeda camp in Afghanistan (news - web sites) himself.


However, he was released from custody after German investigators informed the court of secret testimony which the trial judge presumed to have come from key al Qaeda figure and U.S. captive Ramzi bin al-Shaibah.


That testimony suggested Mzoudi did not belong to the core group of plotters based in Hamburg.


Prosecutors, who are calling for a 15 year jail term, did not say how they had found their new witness only three days before the verdict was due.

German investigators, asked by judges to assess the credibility of the witness, said he had been keen to be paid for his cooperation, although he had not openly demanded money.

Ruehle said he and the other four presiding judges would continue to assess the credibility of the new witness on the trial's next scheduled sitting next Thursday.

He had told them he had left Iran in mid-2001 and warned the U.S. embassy in Azerbaijan of the impending attacks, informing officials that he had been employed by the CIA since 1992.

The new witness also referred to what he said was an al Qaeda message urging that Mzoudi "be eliminated" lest he implicate other al Qaeda members.

On the same day, fellow Moroccan Mounir El Motassadeq is also expected to hear whether an appeal against his conviction last February on similar charges has been successful. Motassadeq was sentenced to 15 years, but could win a retrial.

They can start with his name. As Zakeri cheerfully admitted during a telephone interview with the Tribune from a hotel room in Germany, the name is a phony one--bestowed on him, he says, during his years of service as an Iranian intelligence agent.

Other parts of Zakeri's story may prove harder to nail down, but also more consequential. Zakeri says the supreme Iranian leader, Ayatollah Ali Khamenei, and the country's former president, Hashemi Rafsanjani, both were fully informed well before Sept. 11, 2001, that a brutal attack on America was planned.

"They were informed by Al Qaeda," which "needed the Iranian government's help," Zakeri says.

He says he knows this because he was working for a security and intelligence unit operating out of Khamenei's office in early 2001, when Iran was visited by Osama bin Laden's chief deputy.

Then, "four months and five days before 9/11," Zakeri says, one of bin Laden's sons, Saad bin Laden, turned up in the Iranian capital, met with Khamenei and Rafsanjani and gave them the details of the Sept. 11 plot.

His account, he says, can be corroborated by the Iranian security agent who served as Saad bin Laden's bodyguard during the visit, and who now is living quietly in Najaf, Iraq.

Zakeri has much more to say: He remembers seeing Mzoudi at the Iranian intelligence headquarters "four years before 9/11."

If confirmed, Zakeri's testimony will not help the 31-year-old Mzoudi who has denied charges that he knowingly assisted the Sept. 11 hijackers in their preparations for worst terrorist attack against the U.S. Moreover, any proven link between Sept. 11 and Iran would pose a challenge for the Bush administration, which has vowed repeatedly to punish any foreign government--as it did the Taliban in Afghanistan--whose fingerprints are found on the attack.

The 11th-hour appearance of Zakeri, who says he is 40 years old and was born in the central Iranian city of Esfahan, has thrown Mzoudi's trial into disarray. Zakeri, who is keeping his whereabouts a secret because he fears retaliation from the Iranian government, nevertheless insists that he is willing to testify at the Mzoudi trial, which is taking place behind bulletproof glass in a high-security Hamburg courtroom.

Dr. Ulrich von Jeinsen, a German lawyer who represents the families of some of those who died on Sept. 11, and who would like to see Mzoudi convicted, attended Thursday's session and said he was inclined to believe what Zakeri has to say. The BKA, von Jeinsen said, had "checked his position in the Iranian secret service, and it's true. Now they will try to verify other details."

New court hearing set

The court will hear the results of those inquiries Jan. 29, at which time the five judges can either deliver a verdict in the case, as they had planned to do this week, or ask the BKA to provide more information about Zakeri's assertions--and, possibly, to produce Zakeri himself.

Ali Nouri Zadeh, a Iranian-born writer for the London-based Arab newspaper Al-Sharq Al-Awsat who first interviewed Zakeri more than a year ago, has mixed feelings about the man's veracity.

"What he says is partly correct--30 percent," Zadeh says. "Partly exaggerated--20 percent. And 50 percent is nonsense."

Told that some German and American intelligence officials had greeted his revelations with pronounced skepticism, Zakeri replied: "I don't know why they say that. We got lots of evidence."

At least some of what Zakeri says is inconsistent with known facts. Zakeri told the BKA, for example, that he had seen one of the hijack pilots, Ziad Jarrah, at a terrorist training camp in Iran in 1997, four years before Sept. 11.

"I did not recognize the person then," he said. Only after seeing Jarrah's picture in the wake of Sept. 11, Zakeri said, did he remember that "I had seen the person on the picture in Iran. ... I did not know his name before."

However, 1997 is the year that Jarrah arrived in Hamburg from his native Lebanon to study aircraft design at Hamburg's University of Applied Sciences. By all accounts he was the antithesis of a radical fundamentalist Muslim, spending his free time drinking, driving sports cars and living with a Turkish girlfriend. BKA interviews with Jarrah's neighbors and fellow students suggest that Jarrah didn't become radicalized until 1999, the same year he and several of the other hijackers visited an Al Qaeda training camp in Afghanistan.

Zadeh says he was able to confirm, with sources inside and outside Iran, that Zakeri did work for an intelligence unit of the hard-line Revolutionary Guards, a kind of fundamentalist counterpart to the regular Iranian army, and then for a special security unit in Ayatollah Khamenei's office.

"That's where he got his information and documents," says Zadeh, who says he has examined the documents and that some are genuine "and some are not."

Zakeri said that in July 2001, two months before the Sept. 11 hijackings, he visited Azerbaijan, the former Soviet republic with which the U.S. now has diplomatic relations, and gave CIA personnel at the U.S. Embassy there a letter addressed to President Bush that warned of a major impending attack on U.S. soil. Zakeri, who says he also faxed a copy of the letter to the White House, claims it described a scale model of the World Trade Center and other high-rise buildings that suddenly and mysteriously had appeared in a hallway of the Iranian intelligence service's headquarters--and which he was told by a deputy intelligence minister would be the target of the attack.

Working for CIA?

In the Tribune interview, Zakeri was unclear about how much of the information he purports to possess was obtained firsthand, and how much was garnered from friends, acquaintances and other secondary sources after he left Iran. Zakeri claims a relationship with the CIA that dates from a meeting in Canada in 1992, after which he returned to Iran as an agent of the CIA--at least in his own mind. "I was thinking I'm working for them," he said.

The relationship, Zakeri said, culminated with an acrimonious meeting with the CIA and other American intelligence services in The Hague four months ago. "I told them the same story," Zakeri says. "They want me to say a different story. I said, `This is the truth that I'm saying.'"

The CIA has declined all comment on Zakeri, citing the Hamburg trial. German news reports say Zakeri walked, uninvited, into the Berlin office of the BKA last week and proceeded to tell his story. But Zakeri claims it was the BKA that "brought me to Germany, to be a witness." He won't say from where. "I live all over," he says. "France, Canada ...."

During 5 1/2 hours of questioning Monday, Zakeri told the BKA that among the Al Qaeda figures who visited Iran was Saif Al-Adel, who is under a U.S. federal indictment in absentia for his alleged role in the 1998 bombings of two U.S. embassies in East Africa. According to a transcript of the BKA interview obtained by the Tribune, Zakeri identifies Al-Adel as the Al Qaeda figure "in charge of the execution of" the Sept. 11 hijackings. Saudi intelligence officials believe Al-Adel, a former Egyptian military officer, gave the order--by telephone from Iran--that launched the first of several suicide bombings in the Saudi capital last May.

`Housekeeping' duties

Zakeri also told the BKA that Mzoudi, the defendant in the trial, had been "in touch with Saif Al-Adel." Mzoudi, Zakeri said, "was involved in the logistics of the operation of 9/11/01. His area of operations was to draft and send information to liaison persons, because he knew well how to handle codes."

Up to now, the case against Mzoudi has been circumstantial, resting on evidence showing that he performed a number of logistical and "housekeeping" services for the principal hijackers before and after they left Hamburg to begin flying lessons in the U.S.

In the Tribune interview, Zakeri denied news reports that he demanded money from German authorities in return for his testimony, and also accusations that he stole large sums of money from the Iranian government before defecting to the West.

"It's not true," he said. "I'm a poor man. I'm living as a poor man."

US asks Iran to send Al Qaeda captives home for trial

The United States says it opposes Iranian plans to place suspected Al Qaeda militants on trial and demanded instead they be turned over to their countries of origin for judgment.

The US has detained more than 600 Al Qaeda and Taliban suspects in Guantanamo Bay in Cuba without charge or detention for up to two years and has so far not returned any for trial in their home countries.

"We want to see action, and the action we want to see is that they turn over those Al Qaeda members in their custody to their country of origin," White House spokesman Scott McClellan said.

The White House was responding to comments by Iran's Foreign Minister, who said his country, long accused by the United States of harbouring Al Qaeda militants, would place a dozen jailed suspects on trial.

"They are currently in prison - their relations are cut off from outside and they are going to be tried," Foreign Minister Khamal Kharrazi told Reuters at the World Economic Forum (WEF) in Davos, Switzerland.

Mr McClellan said several countries have asked Iran to turn over the Al Qaeda suspects "so that they can pursue indictments in their own country."

"The Iranians have continued to ignore those requests," he said.

The most important Al Qaeda figure that Western intelligence agencies say may be in Iran is Egyptian Saif al-Adel, the security chief of Osama bin Laden's network.

In addition, Saudi sources said last year that Iran had detained Saad bin Laden, a son of Osama, as well as Al Qaeda spokesman Sulaiman Abu Ghaith and Jordanian Abu Musab Zarqawi.

The latter has suspected Al Qaeda ties and is accused of plotting the murder of a US diplomat in Amman in 2002.

The US has long believed that Iran was harbouring Al Qaeda militants who escaped Afghanistan after US troops invaded that country in late 2001 in the wake of the September 11 attacks.

Shiite Muslim Iran says it is ideologically opposed to Sunni-dominated Al Qaeda and has arrested and deported hundreds of its militants since the Afghan war.

As long as Ayatollahs (Terror Masters) are in power Al Qaeda members will not be delivered to any country because Ayatollahs in Iran have extensive relation with Al Qaeda. U.S. should help Iranian people to overthrow this bloody Islamic regime ASAP.
The War On Terror can not be considered as won as long as the Terror Masters Ayatollahs are in power in Iran. White House please do not waste your time.
